The announcement of Cordray’s departure comes as his office has been under fire for problems with a new version of the Free Application for Federal Student Aid, or FAFSA, released late last year. “If there was a financial aid director, or even a college president, that delayed financial aid on their campus for up to six months, the professional price that would be paid for that would be pretty steep,” Justin Draeger, president of the National Association of Student Financial Aid Administrators, told lawmakers. Cordray’s tenureAs the head of FSA, Cordray oversaw not only the FAFSA but also the entire $1.6 trillion federal student loan system. Like many progressive organizations, the Association of Legal Aid Attorneys, a union that represents public defenders in the New York City area, has been convulsed by battles over Israel’s war in Gaza. A recent article in the right-leaning Free Press revealed the strident and sometimes ugly language that union members used during a fight over a resolution, passed in December, condemning Israel’s actions and supporting a boycott of the country. Nevertheless, it’s disturbing that Congress is now investigating the union over the resolution, an alarming degree of government intrusion into the free speech rights of a private organization. “When union bosses act in a way that is purposefully divisive and combative toward their membership, they challenge the validity of their monopoly.”The idea that the resolution pit “union bosses” against the rank and file is a strange one, since the resolution passed by a vote of 1,067 to 570, but the framing reflects Foxx’s broader hostility toward organized labor. The House Education and Workforce Committee announced Monday it will hold a hearing on April 17 featuring Columbia President Minouche Shafik and the two co-chairs of the board of trustees: Claire Shipman and David Greenwald. The Columbia president declined the invitation due to a scheduling conflict, according to the Columbia Spectator. At a roundtable hosted by the House Education and Workforce Committee, students from Columbia University, the Massachusetts Institute of Technology and other schools described hearing violent chants on campus and complained administrators are not doing enough to fight antisemitism. “In the past five months, I have become traumatized,” said Talia Khan, a second-year graduate student at MIT. Three different Harvard officials are being subpoenaed: Alan Garber, Harvard’s interim president; Penny Pritzker, the billionaire leader of the Harvard Corporation, the governing board of the school; and N.P. The subpoenas order the Harvard officials to produce a series of documents by 5 pm ET on March 4. In 2022, the Utah legislature banned transgender girls from high school girls’ sports. In August 2022, a Utah judge granted a preliminary injunction allowing trans girls to compete on girls’ teams after the parents of two trans girls filed a lawsuit. But as long as transgender girls’ gender identities are policed, cisgender girls will continue to have theirs policed as well. “I avoided athletic activities out of terror, not disinterest,” one participant said (a new study published last month also found that trans girls are primarily avoiding sports out of fear of harassment). If cisgender girls avoid sports out of these fears as well, they stand to be similarly negatively impacted.

New York CNN —A congressional committee probing campus antisemitism is expanding its investigation to include Columbia University and demanding the Ivy League school turn over a trove of documents to lawmakers. Foxx is requesting that Columbia officials produce a mountain of documents to aid the investigation by February 26. Foxx cited a “pattern of deeply troubling” incidents at Columbia in recent months, including “assaults, harassment and vandalism.”Columbia is the fourth university targeted by the House investigation on campus antisemitism, joining Harvard University, the University of Pennsylvania and the Massachusetts Institute of Technology. Foxx also suggested the committee could expand its investigation to include Cornell University. A congressional committee examining campus antisemitism accused Harvard on Wednesday of obstructing its investigation, saying that the university failed to submit documents it had requested while flooding the committee with publicly available pages containing “inexplicable” redactions. Representative Virginia Foxx, a Republican of North Carolina, said Harvard was providing a “limited and dilatory” response to her investigation of the school’s handling of alleged campus antisemitism. Ms. Foxx, chair of the House Education and the Workforce Committee, threatened to use subpoena power to force Harvard to submit more documents. “Somehow, almost two months after the committee first informed Harvard of its intent to request production of specific documents, Harvard provided only a single meaningful document,” she wrote in a letter to the university. Harvard said that it was cooperating with the inquiry and that it “has provided extensive information” with the eight submissions it has made so far.

CNN —The University of Pennsylvania submitted documents Wednesday evening to the Congressional committee investigating antisemitism on campus, beginning what could be a weekslong process of turning over documents. Nick Barley, a spokesperson for the House Committee on Education and the Workforce, confirmed to CNN the committee received documents from UPenn and is currently reviewing them. The university told CNN on Tuesday that it planned a “rolling production” of documents that would take place over the next few weeks. Last month, the committee wrote a letter to UPenn demanding a slew of documents to aid that investigation. “We have grave concerns regarding the inadequacy of Penn’s response to antisemitism on its campus,” Rep. Virginia Foxx, the Republican chairwoman of the Education Committee, wrote to UPenn leaders last month.

CNN —Turn over a trove of documents about antisemitism on campus or face a subpoena. “If the above priority requests are unfulfilled by the deadline set above, the Committee is prepared to issue a subpoena,” Foxx wrote. Garber, who replaced Claudine Gay after she stepped down last month, has signaled Harvard will cooperate with the House investigation. That document is a set of recommended goals and steps to address antisemitism by Harvard’s antisemitism advisory group. Most of the documents Harvard has turned over are publicly available, including more than a thousand pages of student handbooks and university rules, according to the House committee.

There are few aspects of America’s past that haven’t been impacted by conscientious Black people and their resistance to systemic racism and illiberal democracy. The situation at Harvard has been made more dire by the university’s failure to push back sufficiently against broader political attacks. Another vocal critic of Penslar is the former Harvard president Lawrence Summers, who was also an outspoken opponent of Gay’s. As an academic institution, we should be leading the resistance to these assaults on higher education, not bowing to them.
